Liability Waiver
Voodoo Travel, Sociedad Limitada, constituída en escritura pública otorgada ante Don José María Florit de Carranza, Notario del Ilustre colegio notarial del Sevilla, e inscrita en el Registro Mercantil con fecha de 21 de junio de 2010, libro 0, tomo 5260, folio 8, con CIF número B-91886713 y CIAN número 411023-2, y con domicilio social en Sevilla, calle Joaquín Guichot, 6 Local, con poderes de representación conforme a escritura pública autorizada por Don José María Florit de Carranza, Notario del Ilustre colegio notarial de Sevilla con fecha de 21 de junio de 2010 manifiesta su voluntad de asistir en todo momento a sus clientes y mostrarles su máxima atención y cuidado actuando siempre de BUENA FE.
En cumplimiento de la normativa vigente no aceptará reclamación por cancelación o cambio de sus actividades basada en circunstancias de fuerza mayor, incluidas metereológicas. Así mismo las personas que participan en nuestras actividades, manifiestan ser mayores de edad y capaces de decidir participar en las mismas, si hubiere riesgo para su integridad personal, acuerdan y firman conocerlo y en ningún caso hacer responsable de los daños físicos: a la empresa, ni a sus empleados, o colaboradores. No habrá responsabilidad por aquellos objetos materiales, perdidos o dañados, que deberán ser vigilados por sus propietarios, la empresa no tiene obligación de ser depositaria de los mismos, y advierte de ellos a sus clientes.
DiscoverSevilla reserves the right to change these terms and conditions at any time by posting changes on the website. It is your responsibility to review the website terms and conditions regularly to ensure you are aware of the latest terms and conditions. Your use of this website after a change has been posted will be deemed to signify your acceptance of the modified terms and conditions.
Excursion Cancellation Policy – DiscoverSevilla (DS) excursions
All cancellations must be submitted in writing. DiscoverSevilla is not responsible and no money will be refunded for cancellations based upon sudden illness, weather conditions, or acts of terrorism. Also, it is the client's responsibility to ensure they meet entry requirements for destinations of any trip or excursion booked through DiscoverSevilla. As such, no refund will be issued to clients who lose or unable to find their travel documents or show up for the trip yet are unable to travel or check in to the hotels due to improper and/or lost documentation.
Customers who cancel their reservations up to 7 DAYS prior to the departure date of the excursion will receive an 50% refund of the amount paid. Customers who cancel their reservations between 3 AND 7 DAYS prior to the departure date of the excursion will receive a 40% refund of the amount paid. Customers who cancel their reservations 3 DAYS prior or less to the departure date will receive no refund. Under no circumstances will refunds be granted for customers who fail to arrive on the day of departure.
Customers who change departure dates or trips will incur a fee of 10 Euros. If the client switches to a different trip offered by DS, there will be no refunds of monies if the new trip costs less. However, if the new trip is more expensive, the client is liable and will be charged the difference. There will be no charge for departure dates changed or rescheduled by DiscoverSevilla.
Again, under no circumstances will refunds be granted for customers who fail to arrive on the day of departure. Submission of an online booking does not guarantee you a spot on the trip. Your reservation is neither confirmed nor guaranteed until final payment is received. All reservations are unconfirmed that cannot be processed due to inaccurate card number or the credit card being denied. By submitting an online booking, you are agreeing to have your card charged according to the stated rip price anytime prior to trip departure date. It is the responsibility of the client to ensure that they are providing accurate payment information in order to successfully secure a reservation on DS excursions.
Under no circumstance shall DiscoverSevilla and its employees/guides be liable for baggage damage or loss, loss of personal property, possessions or monies; personal illness; injury, arrest or conduct of any participant throughout the trip. The client agrees to assume all risk of injury and loss that may arise as a result of participating in this excursion and further agrees to hold: DiscoverSevilla and all its employees/guides, harmless for any injury or loss that arises as a direct or indirect result of any act or omission of any third party.
DiscoverSevilla reserves the right to cancel this excursion provided all monies collected will be returned in a reasonable amount of time. DiscoverSevilla also reserves the right to remove any client from the excursion who is being disruptive or harmful to themselves, others, or property. If removed, the client will not be issued any refund and will be responsible for all costs needed to get back to departure city.
Last Minute Bookings
DiscoverSevilla clients who sign up three days or less prior to the trip departure date will be charged the stated trip cost plus a 10€ fee for last minute processing and handling of their reservation.
DiscoverSevilla Meeting Point
DiscoverSevilla´s Meeting Point is the Consulado de Portugal unless otherwise stated. It is the responsibility of the client to ensure they know where the meeting point is and that they arrive on time to the trip meeting point on the stated trip departure day and time. It is the responsibility of the client to contact DiscoverSevilla with any questions or concerns regarding the meeting point. DiscoverSevilla is not liable for clients who fail to arrive on time or fail to arrive to the correct meeting point. No refunds will be granted to clients who do not arrive or who arrive late to the DiscoverSevilla Meeting Point.
DiscoverSevilla Trip Organization
Based on amount of reservations, DS occasionally has to organize and divide the trip among several hotels and also have the buses leave at different departure times. DS is dedicated to organizing the groups as per rooming and group requests that the clients list on their reservations. However, DiscoverSevilla shall not be liable for any refunds, claims, or loss of enjoyment of any nature or kind whatsoever related to client´s dissatisfaction with how the trip is divided as ultimately hotel rooms, bus spots, etc. are limited.
For DiscoverSevilla Morocco excursions, in the event of weather conditions that prevent the ferry from crossing the Strait of Gibraltar, the trip will be postponed until the group is able to cross. In the case of a postponed return to Spain, all extra costs (hotel stays, meals, etc.) incurred during the postponement will be the responsibility of the customer.
For DiscoverSevilla Horseback Riding excursions, in the event of weather conditions that prevent participation in the excursion, the excursion will be rescheduled for a later date. If the customer cannot attend the alternate date, then the customer will receive a 75% refund.
For DiscoverSevilla Gibraltar excursions, in the event of weather conditions that prevent participation in the excursion, the excursion will be rescheduled for a later date. If the customer cannot attend the alternate date, then the customer will receive a 50% refund.
Forces Majeure, Forces Beyond Control
DiscoverSevilla shall not be liable for any refunds, claims, losses, damages, costs expenses, delays or loss of enjoyment of any nature or kind whatsoever, to you or your traveling companions or group members resulting from events beyond our or a supplier's control including but not limited to acts of God, strikes, lockouts or other labour disputes or disruptions, wars, blockades, insurrections, riots, protests, earthquakes, flight and ferry cancellations or interruptions, weather conditions, floods, or acts or restraints imposed by government authorities
DiscoverSevilla is not responsible and no money will be refunded for cancellations based upon forces beyond DiscoverSevilla´s resonable control. Such examples include, but are not limited to, blackouts, storms, road closures, health risk outbreaks, transportation strikes, protests, general strikes, international visa work permit delays, acts of terrorism and acts of God. Furthermore, if the trip has departed and is interrupted by forces beyond DiscoverSevilla´s control, the DiscoverSevilla client understands and acknowledges that they must pay all extra costs to return back to city where trip departed. DiscoverSevilla client is liable and responsible for any costs that are incurred on their behalf as a result of a trip interruption, extension, or delay including but not limited to country-wide protests, natural disasters, etc, may include, without limitation, extra lodging, meals, fees to change scheduled bus schedules, other transportation costs and itinerary changes.
Group Bookings & Promo Codes & Credits
Applied promo codes may not be used on previous purchases and may not be redeemed for cash. DiscoverSevilla reserves the right to cancel and/or void promo codes and their applied discounts to the total trip cost if all members of the group do not sign up and purchase their spot on the trip and/or if the trip itself has not met the minimum number of reservations needed to run the trip.
In respect of a discounted booking (and unless expressly provided otherwise in these Terms and Conditions), if a client cancels or chooses not to use their booking, then they are not entitled to a refund of the promo code or any reinstatement of the promotion; if a client is entitled to compensation (for these purposes compensation includes a full or partial refund, credit or some other form of compensation) for their booking, then such compensation shall not include the amount of the discount; if the client changes their booking then they will not be entitled to a refund of the Discount or reinstatement of the Promotion. Promo codes are ONLY applicable to clients who have not yet signed up for the specified trip date and can NOT be applied to trip reservations that have already been processed and confirmed.
Any credit with DiscoverSevilla, including but not limited to vouchers, special discounts, special program prices, etc, are non-transferable and are applicable to DiscoverSevilla trips only during the current semester and are automatically void at the end of given period.
Trips to Europe/ Airline tours Cancellation Policy
All cancellations must be submitted in writing. DiscoverSevilla is not responsible for cancellations based upon sudden illness, weather, acts of terrorism, or late arrivals to the airport. The customer will have to call the airline directly and try to get another flight at his or her own cost. Once the clients agree to the price and dates of a trip anywhere in Europe, payment is not refundable and the trip can not be re-scheduled. However, it can be re-scheduled at a cost to the customer. Also, when purchasing a flight ticket through DiscoverSevilla the customers agree to the following terms and conditions:
- If the customer does not take the flight due to a flight cancellation by the airline, the costumer will receive a refund of the full cost of the trip minus 30% for the agency fee.
Hostels
There is a 10% deposit that is included in the hostel price and is nonrefundable when booking a hostel reservation with DiscoverSevilla. Any cancellation will result in a refund less the 10% deposit.
“Things to do” Cancellation Policy
Booking any activity (things to do) through the website means that costumers have to call, email or stop by to re-schedule the reservation. If it is possible to change the date with no cost to DiscoverSevilla, then the customer will not be charged any penalty. However, if the costumer wants to cancel the reservation after confirmation has been sent by DiscoverSevilla, 90% will be refunded if the cancellation is submitted 15 days prior the reservation, 80% if submitted 7 days prior the reservation, and 50% if submitted 3 days or less prior to the date of the reservation. DiscoverSevilla books third party companies for the "Things to do" activities and as such, is not responsible for any decisions made by the third party such as trip cancellation due to inclement weather. All issues must be directed towards the third party company.
Property Damage Policy
DiscoverSevilla reserves the right to refuse service to anyone whose condition or conduct could endanger or discomfort himself or herself or others. All extra charges that result from disruptive or destructive behavior are the responsibility of the customer and will be charged to the credit card listed below or the credit card used to make the purchase.
Sickness & illness
All costumers agree that DiscoverSevilla is not responsible for medical treatments, including sickness that any costumer might have or develop on a trip. Customers are required to have their own medical insurance.
Internet Services
DiscoverSevilla offers internet connection services through its website, but if the costumer wishes to cancel their contract with the internet company, the costumer will have to call directly, either from DiscoverSevilla office or their own mobile/resource. DiscoverSevilla will do it best to help costumers in all they need, but contract cancellations must be done directly with the internet company with its licensor.

There are no refunds or exchanges permitted under any circumstance.
